Management Liability

Management Liability policies are the first line of defense for many daily exposures excluded by BOP’s and Commercial General Liability policies. The simple fact of the matter is that many GL and BOP policies have major coverage gaps when it comes to certain areas. Add-on endorsements offered with these primary policies don’t perform an adequate job at covering claims when it comes to D&O, EPL, Fiduciary, Crime and K&R exposures. Call us and let us assist you in making sure all of your clients’ bases are covered.

Directors & Officers/D&O

Probably one of the most important, but least understood of insurance coverages is D&O.   Essentially, D&O insurance is liability coverage for company managers, officers & directors to protect them from claim situations that arise out of their direction and decision making.  The personal assets of these individuals are now protected through this coverage (Side A) as would be the expenses the company incurs (Side B).

Don’t let your insured’s think they’re OK because they have the “corporate shield” of a company of non-profit to protect them.  They could be going into their own pocket for defense costs and damages.

Fiduciary Liability

Employers are held accountable for the benefits options and plans that they offer to employees.  Under the Employee Retirement Income Security Act of 1974 (ERISA), employers / fiduciaries can be held personally liable for losses an employee incurs from a benefit plan, as a result of the employer’s negligence or breach of their fiduciary duty.  Lawsuits can be brought by employees (plan participants) or the local, state or federal government.

Make sure your insureds are protected against administrative errors, denial of benefits, improper advice, conflicts of interest, etc.  Get them the Fiduciary coverage they need – ask us, we can help.

Crime

Help your insureds protect their assets from losses due to dishonesty, theft or fraud. Employees, interns or 3rd party contractors can forge checks, commit computer crime and steal from their employers or non-profit organizations. In many cases, this can go on for long periods of time before being notices, but by then, the financial and reputational damage has been done.

Adding Crime coverage to an client’s insurance plan is a great way to give them peace of mind about these exposures. Give us a call – we can help!

Kidnap & Ransom, including “Active Shooter” coverage

Today’s K&R polices go well beyond just covering the expenses and payments around abduction.  Coverage is now designed to minimize the financial impact of kidnapping, illegal detention, extortion and evacuation of unsafe situations.  Many policies will also extend coverage to insureds’ family members, including those on vacation, students away at school, etc.  Many now include coverage for “Active Shooter” incidents where they will help evacuate and insured from a perilous situation where there is an active, uncontained shooter.
